Terms and Conditions

1. General

These terms and conditions ("Terms") apply to the sale of all goods online in the business to consumer sector between Munich Punk Shop and any customers as visitors to the website www.munich-punk-shop.de  Supplements to the Terms are only considered binding when accepted by Munich Punk Shop in writing.

The sale of goods is limited to quantities for private use. There is no miminum order quantity. No contract shall exist between you and MunichPunk Shop for the sale of any goods until we accept your order by e-mail, confirming receipt and acceptance of the order subject to the Terms. All goods are subject to availability. If we have insufficient stock to deliver the goods ordered by you, we will inform you of this as soon as possible by e-Mail.

2. Delivery

The terms for delivery and payment are specified in the order form. Should a delivery in separate shipments be of advantage for speeding up delivery we reserve our right to split up the shipment accordingly. You shall be required to pay an additional charge for delivery, the amount of which shall vary according to the particular goods and the delivery method that you choose in case you chose a form of delivery other than specified in the order form. The risk of the goods delivered to you whilst in transit passes to you as soon as the goods are handed over to our logistic partners.   

3. Right to Cancel

a) You may cancel an order for goods for any reason in writing (e.g. in the form of letter, fax or eMail) within 14 days, beginning with the day after the day on which you received the goods (in case of split shipment when you receive the first shipment). You can also cancel your order by returning the goods. The deadline for your notice of cancellation is met by sending the written cancellation of order or returning the goods within 14 days to the following address:

b) We shall provide a full refund for goods returned in accordance with these Terms and paid for by you, free of charge as soon as possible and in any event within a period not exceeding 30 days, beginning with the day on which the notice of cancellation is given by you. The return postage for goods with a total value not exceeding 40 Euro has to be paid by you, in the case of goods with a total value of more than 40 Euro we will refund the return postage. When returning goods, it is your responsibility to take reasonable care to see that the goods are not damaged in transit and are received by us at our address as given above. You shall be under a duty throughout the period prior to cancellation to retain possession of the goods and to take reasonable care of them until you return them to us. No right to cancel applies to audio or video recordings if they are unsealed by you.

4. Warranty / Complaint

Unused textiles can be returned for 14 days from delivery in case they are defective or do not have the desired size.  If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, the goods have to be returned within 14 days from delivery to the address given above. The postage for returning the goods will not be refunded. No warranty applies to special offers, nor to audio or video recordings if they are unsealed by you.

Complaints concerning defective goods have to be made in writing within 10 days after detection. The defective goods including the written complaint and a copy of the invoice have to be returned immediately. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, negligence by you or any third party or any alteration carried out without our approval. We shall not be liable to you for any failure to deliver the goods that have been ordered by you or any delay, damage or defect to the goods delivered which is caused by any event or circumstance beyond our reasonable control.

5. Conditional Sale

The price of the goods is payable in full on or before delivery.  Receipts for payment will be issued on request by email for any purchases made online from the Site.  If the goods are not paid for in full on or before delivery, they shall remain our property until payment is received from you.

6. Privacy Policy

In accordance with § 28 of the BDSG (German Law for Data Protection) we inform you that the data necessary to process your order are handled and stored electronically. We will not sell, distribute or disclose information about you as an individual to any third party.

7. Disposal of Transport Packaging

With regards to sales packaging used for the first time by us and given to private end-users, our company is participating in the Germany-wide collection system of Landbell AG (Kundennummer: 4144735) in order to ensure that our legal obligations under §6 of the Packaging Ordinance (VerpackV) are fulfilled. 8. Governing Law

Munich Punk Shop is based in Munich, Germany. German law applies to these terms and conditions and any sale of goods to which they apply and you agree to submit to the exclusive jurisdiction of the German courts in all matters arising from these Terms.
